.CONSTITUTION
N.B. ASSOCIATION OF APPROVED BASKETBALL OFFICIALS

ARTICLE I - NAME

The name of this organization shall be the New Brunswick Association of Approved Basketball Officials.  (NBAABO)


ARTICLE II - HEAD OFFICE

The head office of the NBAABO shall be in the place of residence of the secretary-treasurer

ARTICLE III - FISCAL YEAR

The fiscal year of the NBAABO shall be September 1 to August 31.

ARTICLE  IV - OBJECTIVES

The objectives of this organization shall be:

1. To promote a high standard of basketball officiating in the province.

2. To help develop, among basketball officials and others associated with the game, a thorough               
understanding of the rules.

3. To encourage basketball officials to rigidly enforce all rules of the game - both in letter and in spirit.

4. To provide qualified basketball officials, when requested by teams, leagues and tournament organizers.

5. To recruit a sufficient number of new members to meet the requests mentioned in #4.

6. To work closely with similar provincial and national organizations for the good sport in  general, and 
basketball in particular.

ARTICLE V - BOARD OF DIRECTORS/EXECUTIVE

1. The NBAABO shall be governed by a Board of Directors which shall be made up of the President    Emeritus, past president, president, vice-president, interpreter, secretary-treasurer, all regional
representatives, the BNB nominee to NBAABO, the NBAABO nominee to BNB, the NBIAA nominee
to NBAABO, the NBAABO nominee to the NBIAA and committee chairpersons.

2. The executive committee of the association shall be the past president, the president, vice-president, secretary-treasurer, interpreter and the president Emeritus.

ARTICLE VI - DUTIES OF BOARD MEMBERS AND EXECUTIVE

1. The president shall be the chief executive officer of this association, shall preside at all meetings, be responsible for all the affairs of the association and, with the assistance of the directors, shall execute  and administer the policies established by the members and shall carry out all other duties normally  associated with this position.  He or his designate from the executive shall represent the NBAABO at the C.A.B.O. supervisors annual meeting.  The president shall be an ex officio member of all committees.

2. The vice-president shall, in the absence of the president, perform the duties of that office and shall  be the chair of the fees and expenses committee and the NBAABO liaison with the NBIAA.

3. The immediate past president be chairman of the nominating committee and the NBAABO liaison to BNB.

4. The secretary-treasurer shall be responsible for all moneys of the association, shall complete a financial statement for all general meetings, shall keep an up-to-date record of names and addresses of all association members, shall record the minutes of all meetings, and see that they are distributed to the membership, and perform other duties assigned by the president.

5. The interpreter shall be the chair of the education and interpretations committee and shall be responsible for ensuring that all duties assigned to that committee are carried out and for acting as the NBAABO appointee to CABO in respect to interpretations.

6. All regional representatives shall assist the executive in carrying on the work of the association in their region, shall represent the views of regional members, shall act as the chair of regional meetings, and shall have general responsibility for recruiting, regional clinics and training programs, rules interpretation and regional administration.  The regional representative may be assisted in his duties through the appointment or election of a regional committee.

7. The President Emeritus shall be responsible for such duties as may be assigned by the executive.

ARTICLE VII - ELECTIONS

The president, vice-president, interpreter and secretary-treasurer shall be elected at the annual general meeting of the association in odd numbered years.

Executive members shall hold office for a two-year period, and may re-offer for election if they so desire.

Should there be a vacancy on the Board during the year, the executive shall be empowered to fill it for the remainder of the term.

The President Emeritus shall be appointed by the executive committee.

Regional representatives shall be elected annually at a general meeting of members within a specified region.  This selection shall occur prior to the annual general meeting.

ARTICLE VIII - STANDING COMMITTEES

The standing committees of this association shall be:
a) education and interpretations
b) evaluations and assignments
c) College Board
d) honors and awards
e) nominating
f)  fees and expenses

Chairs for these committees shall be appointed by the Executive and shall serve for a period of two years coinciding with the biennial elections.

Following are duties of the standing committees:

a) The education and interpretations committee shall oversee annual rules and interpretation clinics within each region of the province; shall work closely with CABO and other provincial officials organizations in the holding of inter-provincial clinics; shall ensure common rule interpretations throughout the province; and shall train those who conduct regional clinics.
b) The evaluations and assignments committee shall be responsible for establishing rating and upgrading procedures; shall make recommendations to the appropriate body regarding non-regional assignments; shall establish on-going evaluation procedures; and, shall be responsible for the inter-regional exchange program.
c) The College Board committee shall be responsible for the appointment of officials to the College Board, the assignment of officials and evaluation.
d) The honors and awards committee shall recommend for recognition to the NBAABO, BNB and CABO those who have demonstrated a long-term dedication to basketball and in so doing have brought distinction to this organization and to the sport in general.  The committee is responsible for the NBAABO service awards program.
e) The nominating committee shall be responsible for bringing to the annual meeting a slate of officers to be considered for election by the general membership.
f)  The fees and expenses committee shall be responsible for recommending to the general membership the fees and expenses to be charged by association members.

ARTICLE IX - MEMBERSHIP/VOTING

1. There shall be two classes of membership in this association - active and associate.

2. An active member is one who is actively engaged in officiating or is qualified to do so.  An associate member shall be one who is interested in the promotion of basketball but may not be personally engaged in officiating.

3. Only "active" members in good standing are entitled to vote at Association meetings.

4. Any person may become an active member of this association by:
a) filing an application with the secretary-treasurer
b) paying an application fee
c) successfully passing the written examination and the practical examination
d) paying the balance of his first  years dues within 30 days of receiving a notice to do so
e) thereafter paying an annual membership fee by April 30th
f)  officials shall not be eligible for assignment until the annual dues have been paid.  Payments received after April 30th shall be subject to a surcharge of ten dollars.
g) membership dues shall be received by the Secretary-Treasurer on or before November 30th of  each year.  Applications postmarked or presented in person after November 30th shall not be accepted.

5. Any members who violates the provisions of this constitution or who commits an act contrary to the good of basketball or this association  may be suspended by the executive.  This suspension may be appealed to the Board, whose decision shall be final.

6. An associate member shall file an application with the secretary-treasurer and shall pay an annual fee set by the Executive.

ARTICLE X - DUES, FEES AND EXPENSES

1.  The annual membership dues for members of the association shall be set at a general meeting, and shall be payable not later than April 30th.

2.  Fees and expenses to be charged by members of the association shall be set at an annual, semi-annual or special meeting (called for that purpose).  In this regard the meeting shall consider a report of the fees and expenses committee, and the amounts finally approved shall apply to the following season.

3. Application fees for new candidates shall be set by the executive.

4. a) The new candidates fee is applicable to the first year of officiating only.  The first year is deemed to be the year in which a candidate has successfully passed the written examination and the practical examination.
   b) New candidates will pay a five ($5) non-refundable fee to be applied toward their new officials membership fee after successfully passing the written and practical examinations.

5. Members shall pay annual membership dues of sixty ($60) dollars.  New members shall pay annual membership dues of thirty ($30). (Starting 1998/1999)

ARTICLE XI - MEETINGS

1. The annual meeting of this association shall be the weekend prior to the Thanksgiving weekend, at a  location set by the Executive.

2. The NBAABO Board shall meet at least twice annually.

3. Board and special general meetings may be called at any time by the president or by a majority vote of the Board of Directors.

4. Regional meetings shall take place at least once per year at the call of the regional representative or at the  direction of the Executive.  A meeting must take place prior to the annual general meeting.   

5. Executive meetings shall be held as required at the call of the President or a majority vote of the Executive.   

ARTICLE XII - REGIONS

1.For the purposes of this association, the province shall be divided into six regions.
NOTE: SIX REGIONS INCLUDE
ZONE 1:  WOODSTOCK
ZONE 2:  FREDERICTON
ZONE 3:  ST. STEPHEN
ZONE 4:  SAINT JOHN
ZONE 5:  MONCTON
ZONE 6:  NORTH SHORE ( combining CAMPBELLTON, BATHURST & NEWCASTLE)

ARTICLE XIII - QUORUM

1. For Executive or Board meetings, a simple majority shall constitute a quorum.

2. For annual or special general meetings, ten members in good standing shall constitute a quorum.

ARTICLE XIV - AMENDMENTS

1. This constitution may be amended only by a two-thirds majority vote of those active members present at the annual meeting, or at a special meeting held for that purpose, provided that 30 days notice of such special meeting is circulated. 


OPERATIONAL PROCEDURES
N.B. ASSOCIATION OF APPROVED BASKETBALL OFFICIALS


SECTION I - WORKING CONDITIONS

1. No official shall work a game alone except as "An Act of God".

2. No official shall work a game with a non-member unless the non-member has filed, in good faith, a written application for membership for that season or year.

3. In any region where an assigning system has been established, no official may accept a game that has not been assigned to him by an assigning officer.

SECTION II - DRESS

1. All association members are required to wear the standard dress of the association:  a) official (CABO) gray shirt (black trim) with appropriate crests in the appropriate locations, b) black trousers, c) black shoes and black socks.  NOTE: Officials qualified under IABBO, may also wear that association's proper dress provided both officials are dressed the same.

SECTION III - CODE OF CONDUCT - UNETHICAL BEHAVIOR - COMPLAINTS

1. CODE OF CONDUCT
An official will:
- maintain the highest standards of honesty and integrity,
- make decisions without deference to team, score, spectators or home facility,
- maintain consistency while interpreting and enforcing the rules of Basketball,
- exhibit concern for players welfare by correcting situations which involve actions detrimental to the welfare of all participants,
- maintain a friendly and communicative attitude toward players, coaches and spectators on and off the  court,
- maintain a sense of composure at all times,
- always wear the proper uniform and be neatly and appropriately attired,
- consistently strive to improve ones own ability through regular attendance at rule clinics,
- honour all obligations and commitments,
- be fully prepared both physically and mentally for each game,
- promote and support the sport at all times,
- treat other officials with professional dignity and courtesy, and will refrain from criticizing other  officials,
- refrain from the use of alcohol and misuse of drugs, on the day of the game (prior to the game).

2. In matters involving unethical behavior by officials or others associated with a game, it shall be the responsibility of the regional representative to investigate and determine if further action is required by the NBAABO.  Regional representatives shall keep the secretary-treasurer advised of all developments by copies of all correspondence and at the secretary-treasurer's discretion, the matter may be referred to the provincial executive.

3. Any complaint by one official about a fellow official, must be in writing and filed with the secretary-treasurer, who shall see that it is submitted to the executive committee for appropriate action.

4. The NBAABO will only act upon written, signed documents.


SECTION IV - EDUCATION AND INTERPRETATION

1. The chair of the education and interpretation committee shall ensure that all clinicians are properly trained, are providing the same rule interpretations and mechanics, and appropriate teaching aids.


SECTION V - EXAMINATIONS

1. All qualified and prospective officials shall be required to annually write the CABO exam.  The CABO exam shall be written by officials throughout the province on the date established by the executive.  The exam shall be written without external aid and be supervised by the regional representative or his delegate.

2. The pass mark for the CABO exam shall be 86%.  Failure to achieve this mark on two consecutive examinations shall result in a reduction in rating from A to B.  The pass mark for a B rating shall be 75%.  Failure of a B official to achieve this mark on two consecutive exams shall result in forfeit of active membership.

3. Those officials wishing to officiate at the AUAA (University Men's) level shall write the annual CIAU examination, the pass mark for which is 86%.


SECTION VI - RATINGS

1. According to marks obtained on the annual examination(s) and/or practical floor tests, all active officials shall be rated as a B, A, or AA official.

2. Prospective officials shall first register with the association, pay the appropriate fee, attend instructional clinics, and then be eligible to write an annual examination.  To become eligible for a floor test, he must attain a mark of at least 74% on the written examination.  Floor tests shall be conducted at the local level under the supervision of the regional representative.  The pass mark on the floor test shall be 74%.  If a prospective official passes the floor test, he shall immediately become a rated B official.

3. All officials shall be rated as B officials for at least one season and until upgraded to an A.  An official wishing to be upgraded must first make a mark of 86% on the annual CABO examination, receive the recommendation of the local Zone Representative, and then advise the secretary-treasurer of his desire to be upgraded.  The evaluation and assignment committee shall be responsible for evaluating all candidates and shall do so, whenever possible, at an annual, standard "central upgrading clinic" to be held in conjunction with an appropriate tournament of high school age or above.  A panel of at least three  association members shall evaluate these candidates for A ratings.  The pass mark for this floor test shall be 86%.
     
4. Officials wishing to be upgraded to AA shall first  make a mark of 86% on the annual CIAU examination and then advise the secretary-treasurer of his desire to be upgraded.  The evaluation and assignment committee shall then decide the best method(s) for administering floor tests for such candidates.  A panel of at least three association members with experience in CIAU rules shall evaluate these officials.  The pass mark for this floor test shall be 86%.

5. Candidates being examined for upgrading purposes, should not expect to be paid for the game in which they are being evaluated.

6. To be eligible for national and international assignments, an NBAABO member in good standing must meet the criteria outlined in the CABO constitution.


SECTION VII - ASSIGNMENTS - GENERAL

1. It shall be the duty of each regional representative to see that an assigning officer is named.  These assigning officers shall assign officials to games within each region, in return for which they must assess and collect 8% of the game fees from the officials assigned.  Any zone assignor who is not charging an assignment fee of 8% must be removed from the position.

2. No official shall accept a game that has not been assigned to him by an assigning officer.

3. All assignments within a region shall be the responsibility of the regional assigning officer with the exception of the following:  a) College Board, b) NBIAA Championship Tournaments, c) National or International assignments.


SECTION VIII - ASSIGNMENTS - NBIAA CHAMPIONSHIPS

1. Only A or AA rated officials in good standing shall be eligible for tournament assignments.

2. Where feasible, not more than two officials from any one region shall be assigned to any regional tournament.

3. Each official who wishes to be considered for a tournament assignment shall submit to the regional representative by January 15 the dates on which he is available.  The evaluation and assignment committee shall then be responsible for seeing that tournament assignments are made. Each regional representative shall submit a prioritized list of officials to the secretary-treasurer by January 31st; from this list the evaluation and assignments committee will make the appointments to NBIAA tournaments with at least one official from each zone being selected to officiate the "Final Twelve"

4. In order to be guaranteed a zone appointment to the final 12, the zone must submit a minimum of 4 names for regionals. (NOTE: By way of clarification, zones that do not submit 4 names are not excluded from getting one or more final 12 assignments.  They are only excluded from being "guaranteed"  a spot.

5. An official must sit out one year after going to the final 12 for two consecutive years.

6. The evaluation and assignments committee shall cause to be notified all affected officials indicating the tournament assignment, the date and the approximate starting times.

7. Should any official reject a tournament assignment (i.e. all games in a tournament shall be done unless prior consideration were given due to an individual request)  without sufficient cause, after having earlier indicated his availability, that official shall not be eligible for a tournament assignment for the following two years.

8. The evaluations and assignment committee shall ensure that a referee-in-chief is named for all tournaments and that the first day's games are assigned.  It shall be the referee-in-chief's duty to assign officials to subsequent games, to provide constructive criticism aimed at improving the abilities of the officials involved and to liase with the tournament manager relative to officiating matters.

9. The NBAABO Executive may negotiate with NBIAA re fees for referees for NBIAA tournaments.

SECTION IX - ASSIGNMENTS - COLLEGE BOARD

1. Only qualified AA officials shall be eligible for membership on the college board and they shall be the only ones eligible for assignment to inter-university games.  When no college board officials are available, then the college board assigner has the authority to go outside the college board to make assignments.

2. The size of the college board shall be determined annually by the College Board committee.

3. Selection to the college board shall be made by the College Board committee.  The committee will consist of the chairperson, top two officials and any two others.

4. On or before the 15th of September, each regional representative shall submit to the Evaluation/Assignment Committee Chairperson a non-prioritized list of those officials interested in being eligible for nomination to the college board.

5. Selection to the College Board shall be subject to the following:
a)  consideration will only be given to eligible officials whose names appear on a regional list
b)  an official who is in good standing

6. Where no officials are selected from a particular zone, the College Board committee will arrange, upon request, to have the top ranked official from that region, provided they are eligible, officiate an appropriate university level game for the purpose of ranking that official relative to the officials selected to the College Board.

7. All members of the College Board shall be determined before October 15th of each year and all nominees will be advised.


SECTION X - EVALUATION

1. It shall be the duty of each association member to assist fellow officials in their improvements by constructively and positively evaluating their performances and discussing such matters between themselves.

2. In addition, regional representatives may establish such procedures as they feel are appropriate to assist in the evaluation of officials within that region.
a) That the NBAABO have an on-going evaluations of  "B" officials and provide them an       opportunity to participate in the process.
b) That the NBAABO have on-going annual evaluations of "A" officials at the zone level and promote utilization of new evaluation techniques.
c) That the NBAABO forward copies of provincial and regional evaluations to regional representatives for follow-up and make much greater use of evaluations in determining other assignments.

3. The evaluation and assignments committee shall ensure that qualified evaluators are available.

4. The College Board committee shall make every effort to see that each College Board official is evaluated during the season.

SECTION XI - HONORS AND AWARDS

1. The Honors and Awards Committee shall be responsible for recommending to the executive the names of persons to be honored by the association.  The recommendations may take any of the following forms:   a) 15 to 10 years service awards, b) 20-year service awards and, c) nominations for other awards.

2. Nominations for these awards may be initiated by the committee or someone outside the committee.

SECTION XII - RECRUITING

1. It shall be the responsibility of all members to actively recruit new members.
2. Notwithstanding the above, regional representatives of their delegates shall annually catty out publicity campaigns to solicit new memberships.

SECTION XIII - LIAISON WITH BNB AND NBIAA

1. The association shall be formally affiliated with the NBIAA and Basketball New Brunswick and shall work co-operatively with those organizations according to the terms of agreements which shall be mutually agreed to.  These agreements shall be the subject to review by the Executive from time to time.

SECTION XIV - FEES AND EXPENSES

1. Game fees and expenses to be charged by members of the association shall be set at the annual or special meeting called for that purpose.  In this regard, the meeting shall consider a report and recommendations of the fees and expenses committee.

2. Notwithstanding the above, game fees and expenses shall usually be established in the following manner:
a) The vice-president shall chair the committee.  This committee shall review the current fees and expenses, and recommend changes to a meeting.
b) This committee shall make its recommendations following consultation with user groups such as Basketball New Brunswick, NBIAA, colleges and universities, etc.
c) The meeting shall receive the report and recommendation of the fees and expenses committee and shall either accept, reject or modify it.
d) The secretary-treasurer shall then circulate the schedule of fees and expenses approved by the meeting to the membership for a mail vote, the results of which shall be made known to the membership and other interested organizations as soon as possible.
e) The fees and expenses thus approved shall be binding on all members and shall apply to the following basketball season.
f) Individual zones may establish individual travel rates provided they do not exceed the current NBAABO established rates.

SECTION XV - BOARD MEMBERS EXPENSES

At the determination of the board, NBAABO board and executive members be paid out-of-pocket expenses for their meetings, other than A.G.M. and semi-annual meeting.

SECTION XVI - AMENDMENTS

These operating guidelines may be amended by a majority vote of those active members present at the annual meeting or at a special meeting held for that purpose.  In certain exceptional circumstances the Board may amend these procedures subject at the next annual meeting.

**No non-budgeted sum of money exceeding $150 can be spent unless prior approval is agreed upon by the executive.
